Drug Sentencing Guidelines

Dallas Drug Sentencing Guidelines Attorney

Fort Worth Federal Drug Crime Defense Lawyer

If you are facing drug crime charges in federal court, the punishment you face will likely be influenced by federal sentencing guidelines. Although it is no longer mandatory that a judge use the sentencing guidelines when making a sentencing decision, many judges do continue to follow the guidelines, which are quite harsh.

The sentencing guidelines have a starting point of defining a certain amount of prison time based on the total amount of drugs in your possession or under your control. From there, it adds time (enhancements) based upon factors, such as:

  • Whether there was any interstate or cross-border distribution of drugs
  • Whether you were a leader or an organizer in a drug ring
  • Whether there is evidence you participated in a conspiracy
  • Whether there were any weapons involved — even if you were not using a weapon but only that a weapon was found in your car or your home or the location of the drug bust

It is possible to get a judge to depart from the federal drug sentencing guidelines but it takes a defense lawyer who understands how the feds prosecute a case, how the federal sentencing guidelines will apply to your case, and the factors that could lead to a downward departure.

Contact our Dallas, Texas, defense firm. We fight hard to protect our clients' rights in court and to seek the best possible outcome in sentencing. We look for every fact that could justify a downward departure in sentencing, be it age or health problems, your background, or your actual role in the events in question.

We most often see judges offering reduced sentences when the defendant has agreed to provide information that leads to others being identified and arrested. If you agree to "debrief" early in the case, when it's most helpful to the prosecution, it can be to your advantage, but it depends upon the actual facts of your case. We will discuss with you whether it's a good idea to cooperate with an investigation and to accept responsibility, or to fight the charges.
