Indecency with a Child

Dallas Indecent Exposure Defense Attorney

Dallas Indecency With a Child Defense Lawyer

Although a criminal charge of "indecency with a child" is technically a less serious offense than a charge of child sexual assault, the consequences of a conviction can be just as serious. It goes on your criminal record and can be seen by potential employers and landlords. It can prevent you from holding some jobs.

If you are facing criminal charges for indecency with a minor, it is critical to hire a defense lawyer who understands how to fight the charges and who will work aggressively to protect your future.

At the Dallas defense firm of Crain ◊ Lewis, LLP, we have extensive experience defending clients against sex crime charges, including charges involving children.

We recognize that claims of indecency with a minor sometimes result from a misunderstanding about acceptable and unacceptable behavior, and can even be the result of false allegations brought under the influence of another adult. Our defense lawyers are experienced at extracting these issues and preparing the strongest defense given the facts of the situation.

Inappropriate touching and indecent exposure is a form of child sexual abuse that does not involve penetration.

A charge of indecency with a minor is sexual contact with a child under the age of 17 with the intent to arouse or gratify one's sexual desire. This includes touching a child's genitals through his or her clothing, or an adult rubbing his or her genitals against a child while the adult is clothed.

This charge is also brought against adults who expose their genitals if they know a child is present or who expose a child's genitals (if the intent is sexual arousal).

In order for law enforcement to bring a charge of indecency with a child, the "adult" must be older than the "child" by three years or more. In addition, the adult must not have used force, threats or coercion and must not be a registered sex offender.

If force was used against the child, the adult will be charged with the more serious crime of child sexual abuse or statutory rape.
