In both the state and federal criminal justice system, the level of charging of a drug offense (misdemeanor or felony) is based on the amount and type of drug that was possessed.
- Marijuana: Possession of less than 2 ounces of marijuana is a Class B misdemeanor, 2-4 ounces is a Class A misdemeanor, and above 4 ounces is a felony charge.
- Other controlled substances: Possession of some drugs begins as a Class A misdemeanor and moves up to felony charges — this can include legal drugs. With cocaine and meth, possessing even 1 to 4 grams can be a third degree felony.
